In Germany, about 94,000 tax advisers and groupings of tax advisers (Steuerberater, Steuerbevollmächtigte and Steuerberatungsgesellschaften) represent the interests of their clients. They exercise their profession independently, responsibly and conscientiously. The scope of activities includes organising their clients’ personal and business tax affairs, providing advice on all tax-related matters, filling in tax returns and checking assessments. They support their clients in commercial decision-making and act as management consultants. German tax advisers are authorised to represent their clients in fiscal, criminal tax and administrative fine proceedings.

The profession in Germany is governed by statutory regulations. Therefore German tax advisers are obliged to the law on tax advisers and the code of conduct of the profession. They are supervised by the 21 chambers of tax advisers of the German “Länder”, to which they belong by law. The umbrella organisation of the 21 local chambers is BStBK, which legally represents the entire profession at national and international level and deals in Germany with the interests of the individual tax advisers within the framework of self-regulation. As a corporation under public law, BStBK has to act objectively and to be politically neutral, e.g. it does not pursue the interests of any particular group. BStBK further participates in the drafting of laws of the profession and in consultations on tax laws and laws in all other legislative areas of the profession. With regard to tax law and all other legislative areas relating to the exercising of the profession, such as commercial law, company law, insolvency law and the law on social insurance contributions, BStBK either takes the initiative itself or issues opinions on draft laws, regulations and guidelines if asked to do so. BStBK also supports tax advisers, particularly by promoting further professional training. In this regard, BStBK organises numerous seminars and training events and the annual GERMAN TAX ADVISERS CONGRESS.

Due to advanced European integration and increasing globalisation, international and European collaboration becomes more and more important. To handle tasks BStBK is faced with in Europe, an office in Brussels was established many years ago. Recently, and to further strengthen its presence on the European level, BStBK launched in December 2015 together with the Deutscher Steuerberaterverband (DStV, Germany), the Conseil Supérieur de l’Ordre des Experts-Comptables (CSOEC, France) and the Consiglio Nazionale dei Dottori Commercialisti e degli Esperti Contabili (CNDCEC, Italy) the European Tax Adviser Federation – ETAF as an international non-profit organisation (AISBL). ETAF is governed by Belgian law and based in Brussels. Through this commitment, BStBK is a member of an organisation that represents more than 230,000 tax professionals whose activities are regulated by law.
